Survey Policy

This Privacy Policy (the “Policy”) applies to: (i) Personal Information collected via web based survey, telephone interview and/or face to face interview (collectively “Data Collection”) by The Avoca Group, Inc., or its affiliates or sub-contractors (the “Company”). By participating in Data Collection conducted by Company or by a Company sub-contractor on behalf of Company, you agree to the terms and conditions of this Policy. If you do not agree to the terms of this Policy, do not participate in Data Collection.

We reserve the right to modify or amend this Policy at any time by posting the updated version on our website and changing the date listed at the top of this Policy. Any material changes in how we use or share the information we collect will only affect information collected after the posting of the updated Policy, unless otherwise expressly stated. You are bound by any revisions to this Policy and are encouraged to review this Policy periodically for updates.

Collection of Personal Information:

The Company intends to give you as much control as possible over your personal information. In some cases, you can participate in Data Collection without directly telling us who you are. However, in order to participate in Data Collection, there may be times when we need personal information from you.

“Personal Information” is information that identifies or could be used to identify you and that is either collected by us via Data Collection or is otherwise submitted to us by you. We collect information you voluntarily give to us such as your first and last name, e-mail address, company name, physical address, telephone number or any other information (“The Information”) you give to us when you participate in Data Collection, or otherwise provide information to us. When you contact us or we contact you, we may keep a record of that correspondence.

We are also provided with information automatically when you use a computer, tablet, smart phone or other device to interact with us.  We may collect information about the device and how you use it. This may include information about the type of device you are using, your operating system, your browser, your internet service provider, your domain name, your internet protocol (IP) address, and the date and time that you accessed our systems. We do keep track of the domains from which people visit us. We analyze this data for trends and statistics.

There are various technologies, including “cookies” and “pixel tags”, that can be used to provide you with tailored information from a website. A cookie is an element of data that a website can send to your browser, which may then store it on your system. A pixel tag is a type of technology placed on a website or within the body of an email for the purpose of tracking activity on websites, or when emails are opened or accessed, and is often used in combination with cookies. Some of our pages may use these technologies or other technologies so that we can better serve you when you return to our site.

 

How We Use the Information We Collect

Collectively, this information (together with “The Information”) may be used to provide a more customized and enjoyable experience for you and to allow us to fulfill visitor requests. We may also use this information:

Ownership of Content

As such, you hereby irrevocably grant us world-wide, perpetual, non-exclusive, royalty-free, assignable, sublicensable, transferable rights to use The Information for any purpose. Additionally, you irrevocably waive, and cause to be waived, against Company and its users any claims and assertions of moral rights or attribution with respect to The Information. By “use” we mean use, copy, publicly perform and display, reproduce, distribute, modify, translate, remove, analyze, commercialize, and prepare derivative works of The Information.

Third Party Use and Collection of Information

Your information may be shared with our affiliates and with vendors that help us to manage and process the information. We do not sell personally identifiable information to third parties. If we become involved with a merger or a situation involving the transfer of some or all of our business assets, we may share your information with business entities or individuals involved in that process. We may also share your information as required by or permitted by law, including sharing your information with law enforcement agencies or other governmental entities, with third parties in response to subpoenas or other court orders, or to exercise our legal rights or defend against legal claims against us.

We may also allow third parties to collect information about you by setting their own cookies, web beacons and other similar technologies on our systems. Our display advertising partners, which could include companies such as Google and/or AdRoll, use cookies to present you with retargeting advertising on other sites based on your previous interaction with our website. The techniques our partners employ do not collect information such as your name, email address, postal address, or telephone number. By setting your browser to notify you when you receive a cookie, it will give you a choice to decide whether to accept it. How We Protect Your Information

We intend to protect the quality and integrity of your personally identifiable information. We have implemented appropriate technical and managerial procedures to maintain information that is accurate, current, and complete. However, unfortunately no data transmission over the Internet or storage of information can be guaranteed to be 100% secure. Accordingly, we cannot warrant the security of any information you transmit to us and you do so at your own risk.

Our website may contain links to websites/applications that are owned and operated by other companies. This Policy does not apply to websites/applications that are owned and operated by third parties. To ensure your privacy is protected, it is recommended that you consult the privacy policies on any linked websites or applications. We are not responsible for the manner in which others use your personal information or for any damages suffered as a result of viewing or visiting any third party website or application. We also make no endorsement or representation regarding anything found on a third party website or application.

Good Faith Terms and Conditions

All information provided to Company will be taken in good faith and to the best of the respondent’s abilities. This includes providing respondent‘s corporate email address and answering The Data Collection questions honestly and prudently without providing false, duplicate or misleading data in given responses, including those that are inconsistent with prior responses or are statistically improbable.

Violating good faith efforts can result in compromised data; therefore, Company reserves the right to withhold awarding any honoraria associated with The Data Collection, if in Company’s reasonable view, the response(s) are deemed untruthful or not well considered. Furthermore, Company reserves the right to withhold any honoraria awarded under false pretenses. Company has the right to verify respondent’s current employment by requesting a confirmation via their corporate email address. Honoraria for successful completion of The Data Collection will only be awarded once per person, per unique study.

Miscellaneous:

California residents may request a notice disclosing the categories of personal information we have shared with third parties for the third parties’ direct marketing purposes. To request a notice, please contact us as described in the “Contact Us” section, below. We will make every effort to promptly respond to your request.

  • We do not knowingly collect, use or disclose the personal information of children under the age of 13. If you are under the age of 13 you should not provide any information to us. We comply with the Children’s Online Privacy Protection Act. If you are a parent or guardian and believe we may have collected information about a child under the age of 13, please contact us as described in the “Contact Us” section below so we can take reasonable steps to remove that information from our servers.
